Terms of Service

01Agreement to these terms

These Terms of Service form a binding agreement between you and NodePeak ("we", "us") covering every service we operate, including game server hosting, Cloud VPS, free tools and the nodepeak.com website. By creating an account, placing an order or using any NodePeak service you accept these terms in full. If you do not agree with them, do not use the services.

You must be at least 16 years old, or the age of digital consent in your country, to hold a NodePeak account. If you use the services on behalf of an organisation, you confirm you have authority to bind that organisation to these terms.

02Your account

You are responsible for the accuracy of the information on your account, for keeping your credentials confidential, and for everything that happens under your account. Enable two factor authentication where available and notify us immediately if you suspect unauthorised access.

Accounts are personal. Reselling NodePeak services is only permitted with a written reseller agreement.

03Acceptable use

You agree not to use any NodePeak service to:

• Host, distribute or link to content that is illegal in the European Union, the United States or your own jurisdiction.
• Launch, coordinate or facilitate denial of service attacks, port scanning, phishing, malware distribution or any form of network abuse.
• Send unsolicited bulk mail or operate open relays, open resolvers or open proxies.
• Mine cryptocurrency on game server or shared plans.
• Infringe intellectual property rights, including hosting pirated game files or cracked software.
• Harass, threaten or defraud other people, or attempt to gain unauthorised access to systems that are not yours.

We may suspend a service immediately for any reason and without prior notice when its continued operation puts our network, other customers or third parties at risk. Where reasonable we will contact you before or promptly after taking action.

04Game servers and fair use

Game server plans include the resources listed on the order page. CPU, RAM and storage limits are enforced by the panel. Plans are sized for game workloads; running unrelated software that permanently saturates resources counts as abuse of fair use.

Mods, plugins and third party software you install remain your responsibility. We provide installers as a convenience and do not audit third party code.

05Billing and renewals

Services renew automatically at the end of each billing cycle until cancelled. Prices are shown in EUR and converted to other currencies for convenience at live exchange rates; the EUR price is authoritative. Taxes are applied at checkout where required by law.

Invoices are due on their due date. Unpaid services are suspended 3 days after the due date and terminated, including data deletion, 14 days after suspension. We send reminder emails before each step.

• You can cancel any service at any time from the client area; cancellation stops future invoices.
• Promotional pricing applies to the period stated in the promotion and renews at the regular price afterwards.
• Chargebacks filed without contacting support first may lead to account suspension until the dispute is resolved.

06Refunds

New game server and VPS orders come with a 72 hour money back guarantee: if the service does not work for you, open a ticket within 72 hours of activation and we will refund the first payment in full. The guarantee covers the first order of a product per customer.

Renewals, upgrades, addons, dedicated hardware and domain style one off fees are non refundable. Refunds are issued to the original payment method.

07Your content and backups

Everything you upload to your server remains yours. You grant us only the technical rights needed to store and serve it. We take courtesy platform backups, but they are not guaranteed; you are responsible for keeping your own off site copies of anything you cannot afford to lose.

On termination, whether by you or by us, server data is deleted permanently after the retention window described in the billing section. Deleted data cannot be recovered.

08Service changes

We continuously improve the platform and may change, add or retire features. If we discontinue a product you have paid for, we will migrate you to a comparable product or refund the unused portion of your payment.

09Disclaimers and liability

Services are provided "as is" and "as available". Uptime commitments and the remedies for missing them are defined exclusively in our Service Level Agreement. To the maximum extent permitted by law, our total liability for any claim is limited to the amount you paid us for the affected service in the 3 months before the event giving rise to the claim. We are not liable for indirect damages such as lost profits, lost player bases or lost data where you kept no backups.

Nothing in these terms limits liability that cannot be limited by law, including liability for intent or gross negligence.

10Termination

You may close your account at any time. We may terminate the agreement with 30 days notice, or immediately for material breach of these terms, repeated abuse reports, illegal content or non payment. Sections that by nature survive termination, such as liability limits, continue to apply.

11Changes to these terms

We may update these terms as the services evolve. For material changes we will notify you by email or panel notice at least 14 days before they take effect. Continued use of the services after the effective date constitutes acceptance.
